Preface

 

Violence and harassment of a degree never before seen is thriving in the Danish schools. Rape, aggravated violence, blackmail and psychological torture are not uncommon occurrences in the Danish schools of today. Often the children and young adults feel powerless against these criminal episodes. For instance if these frightening injustices are made by students to whom such criminal behaviour is part of their cultural background the teachers are happy to accuse the victim of being the problem - as the students by his (her) cry for help is trying to counteract the criminal (criminals) natural way of expression.

 

The parents of these stricken children do not fare much better against the politically correct school system. This was the personal experience of an Arhusian mother, when her daughter, who was in the third grade, was subjected to physical abuse and severe threats from a boy in the sixth grade. That the criminal in question shouldn't be allowed to freely express his urges was of course unacceptable for the school politically correct teaching staff. The school's staff manipulated the case in a way that the mother of the vic-tim was sentenced for violence herself, Solely because she had complained about the older boy's violent transgressions against her little girl.

 

It is not the opinion of SKOLEVOLD.DK that the official state sanctioned medias receiving government subsidies (e.g. DR) and the official state sanctioned medias (such as the papers) are doing an adequate job of shedding a critical light on the ongoing development. SKOLEVOLD.DK is not afraid to take sides, we believe that there is a clear distinction between good and evil -"If you are old enough to commit aggravated assault, you are old enough to be punished for it." - a weeks suspension from school is in no way an ade-quate measure for an acceptable punishment for crimes of such a degree of severity.

Radio Denmark Should not Receive an Emmy for Abusing Assault Victims

The state broadcasting company: Radio Denmark* has participated in the abuse of assault victims. In the case of “Bispehavesagen” Radio Denmark was known for notoriously practising psychological terror several times against the assault victim, an under-aged girl who had been raped. What characterises Radio Denmark’s work with assault victims is the systematic way it abuses them, a systematic characteristic that was very clearly seen in connection with “Bispehavesagen”. Several Danish scholars and politicians, plus the majority of the Danish people have clearly taken a distance to Radio Denmark’s methods in connection with the abuse of assault victims.

 

Radio Denmark’s systematic abuse has had serious consequences for the girl who was raped in “Bispehavesagen”. A critical part of this abuse was the programme "Ret§agen"**. Several researchers, including jurists and psychologists, had warned about the programme’s terrible effect on the assault victim. Radio Denmark arrogantly disregarded the critique in a way that has to give any sane person the chills. This is the reason why regrettably we have learned that Radio Denmark’s "Ret§agen" has been nominated for an Emmy. It is our only hope that Radio Denmark will not be awarded an Emmy for its abuse of the assault victims.

 

If anyone deserves an award in this case, it is the girl who has been put through the abuse by Radio Denmark.

 

With focus on “Bispehavesagen” there is attached below texts that put the abuse of assault victims by Radio Denmark in perspective.

In connection with the Danish Ministry of Foreign Affairs’ invitation of a number of journalists from EU’s member states as of the 26th to 28th June 2002, the citizens of Denmark and Sweden will carry out a demonstration against violation of the democratic rights in Sweden and the increase in the crime rate in Scandinavia.

 

The demonstration will take place in Copenhagen on Thursday 27th June 2002, at 11:30 in front of the main entrance of the Foreign Affairs Office – Asiatisk Plads, in the corner of Strandgade and Skt. Annæ Gade.

DR2 The Trial - nr. 7 – An issue for debate

In the 7th programme in the "Ret§agen" series, Radio Denmark* wish to discuss the case of group raping in Bispehaven in Århus. Radio Denmark is “outraged” that “politicians and experts” have expressed their opinion about the case without knowing “the facts”. Radio Denmark therefore argues that it is not possible to discuss a “harsher course of action” towards criminal immigrants (Or is that what Radio Denmark wants?). Although Radio Denmark has graciously acknowledged, that the group raping of “a 14 year old girl in a shed in Bispehaven in Århus” (Jyllandsposten, JP 10/01-2001)” did in fact take place. This acknowledgement is not very apparent in Radio Denmark’s preface to the programme though, where it says, although in quotation: “Was it rape?”(Radio Denmark’s homepage).

 

Radio Denmark admits that the programme might have a “severe” affect on the assault victim (JP 10/10-2001), which is warned against by crisis psychologist Anders Korsgaard, Rigshospitalet. Professor of Criminal Law at Århus University Gorm Toftegaard-Nielsen states quite clearly that “Having the girl go through the whole ordeal again is disgusting” (JP 23/12-2000).

 

Radio Denmark is of the opinion that it is presenting “necessary facts” in its programme (JP 23/12-2000). Although these “necessary facts” could be seen in the light that Radio Denmark has had complaints about participating in abusing the assault victim in the Bispehavesagen. Something most people would be reluctant to do, as not to take on an institution as resourceful as Radio Denmark, an institution that can afford to, and is notorious for, pursuing its goal for –if necessary –very long periods of time.

 

The programme is aired 3 times over a couple of days. Which indicates strongly that Radio Denmark is very anxious to have the public aware of where Radio Denmark stand in this matter. As these very delicate cases, that can sway public opinion in different directions, will always attract a certain amount of attention. But regrettably one has to stand idly by while Radio Denmark plies its political interests by abusing a victimized little child.

 

But let us consent to Radio Denmark’s intentions of shedding light on crime by means of the courtroom. What is gained from this? The first thing we learn is that, the things presented in the courtroom are not necessarily in agreement with the real events, for instance with the actual cruelty of the crimes. There are several reasons for this, but one of these could be that with the atrocious nature of the crimes, the prosecutor has assessed that the court will not believe it if it was presented realistically; another reason could be that the prosecutor has given up demonstrating evidence against some of the accused, because of the number of assailants to a single victim, making it impossible to establish a case against all of the accused, regardless of the atrocious nature of the crime.

 

A third and very important point of critique in connection with these types of cases of gang related crimes (which Bispehavesagen certainly qualifies as), is that many of the assailants are never actually put before a court of law, because they are so called underage. Gang related crimes are often characterized by a large number of underage participants (often a majority). This gives gangs several advantages: 1) the underage members are free to participate in different forms of cruelty towards the victim without fear of legal repercussion. 2) The under aged members are free to participate in the crime itself. 3) The under aged members can testify in court to help insure the other assailants who are not under aged go free, and 4) during the trial the under aged members are able to participate in harassing witnesses and victims, that will not do what the gangs want them to (for examples see JP 19/11-2000).

 

This is why it is going to be very interesting to see Radio Denmark’s depiction of the crimes that the under aged assailants committed against the victim in the Bispehavesagen. Among these, crimes committed during the ongoing trial process, where two of the under aged assailants went to the courthouse and harassed the distressed victim in different ways.

 

So one thing is what is being presented in court, another thing is what is brought to the attention of the public. An example is that the judicial powers were widely criticized by the public for not giving out sentences severe enough in the matter of the Bispehavesagen. It was very fortunate indeed (or maybe a clever trick?) that during the process of the trial at the state court only the part where the assailants and their defence counsellors were heard, were open to the public.

 

The judge expressed that this way of handling the case was to protect the victim. But it is hard to see his benevolence when he at same time allowed the defence to freely drag the victim through mud in the medias more or less at will – something he could have prevented.

 

This is in stark contrast to the fact that not even the under aged girl’s parents were allowed to be present at the little girl’s testimony. This makes it interesting to find out if Radio Denmark has been able to access that part of the case files, when not even the girl’s parents were able to witness the testimony. Although Radio Denmark’s purpose with the programme, must be to present the victim’s side of the story as well? Otherwise it will be very difficult to spot the programme’s public utility.

 

The really interesting aspect of the Bispehavesagen trial is the opportunity of cutting to the bone and exposing the malice and cynicism that characterize the actions of these gangs. The cool calculating way that the gangs prepare themselves for example for things like trials. How false rumours about the victim are spread – rumours Radio Denmark among others have quoted on numerous occasions.

 

How untruthful testimonies are given in court and how everything has been planned in advance – regardless of the fact that it is a defenceless little child who already has been abused, that is the target of these gangs cynical calculations – lies and collusion by the gangs whose only purpose is to take as much advantage of the Danish legal system as possible. This is why it is going to be very interesting to see how Radio Denmark deals with these aspects of how the gangs operate in the court of law, which the Bispehavesagen gives an almost perfect opportunity to illustrate.

 

We could hardly suppose that it is the defence counsellors that are spreading these rumours? Or creating these kinds of conditions in court? – It is going to be very interesting to see if Radio Denmark is capable of clarifying this very concrete and easily accessible question in the programme.

 

It is also going to be very interesting to see how Radio Denmark weighs the relation between the assailants and the victim’s allocation of time in programme. The assailants and their defence lawyers make up 12 people (+2 assailants who are underage): a total of 14 assailants and defence lawyers actively participated in the trial. Whereas the victim is a little girl only partially protected by a single prosecutor and an assessor. But we are hopefully able to assume that the viewpoints of the victim and common sense of justice are presented and will take up at least half of the programme?

 

Finally I find it important that Radio Denmark, which we all are contributing to by means of license fee, take in account ordinary people’s points of view of the case – points of view, which have had such a great influence of justice in this case. One of the contributions that Radio Denmark could have used is from Annette Bishop and is reprinted in excerpts below (I have checked the information and sadly they are correct):

“- When I read about the 14 year old girl, I started to cry. The pain that I personally had to struggle with in all those years came pouring back. I was so unhappy for that girl. That was why I decided to write her a letter. If I am in any way able to help her I will be glad to.”

 

And further:

 

“They harassed several of the girls and when I finally hailed a cab to get away the Bikers threatened the cabdriver to throw me out of the car. – I can no longer remember the exact details, but there were about 20 of them, the oldest about 30 years. They were pushing me around, squirting water on me, tearing my clothes and groping all over my body. I was subjected to more or less everything but fully consummated rape. Particular one of the men was very active and very rough with me while the others stood cheering.

 

“YOU LIKE BOYS”

 

I cried and cried it was just so humiliating. There was no one who could help me. Our teachers were at a party in a summerhouse somewhere…..”. –So far if there have been any convictions in this case is unknown, but maybe Radio Denmark could investigate this for us?

 

If the programme takes into account the said conditions, then it could assumable be an excellent programme. If not then the programme should lead to further discussions of the license fee financed editorial line of Radio Denmark.

Group raping in Bispehaven in Århus February 2000

9 Boys screaming and yelling raped a distressed 14-year-old girl, while pinning firmly and covering her with obscenities such as “whore”, and taunting her with comments like: “Here comes the one with the big dick” (Ekstra Bladet 18.11.2000). At the first trial the defence succeeded in ensuring the boys very mild sentences, after which the boys left the court cheering. In connection with the appeal the girl was the target of a particular malicious slanderous campaign. An example is that the two under aged participants of the group raping (who escaped charge, because of their status as minors) came to the courthouse and yelled taunting remarks at the girl. At the time the defence lawyers Morten Wagner, Jørgen Schouby, Bent Nielsen, Anders Mygind and Hanne Gullitz actively participated in the slanderous campaign against the girl. Today the girls’ mother states: “Frankly I’m infuriated that a young girl is left to fend for herself like that while they use all kinds of tricks and dragging her through the mud. I’m surprised that the defence lawyers are able to look at themselves in the mirror in the morning.” (Jyllands-Posten, November 19th 2000).

“Seeing the boys again had serious consequences for T. She is afraid to sleep at night and often need medication in order to sleep at night. The recurring nightmares have been intensified. “She sees their faces outside the window when it’s dark, and she is afraid to sleep facing the wall. She is afraid that they might appear without her seeing it”. The mother tells, she also says that her daughter checks every door and window, before she goes to bed.

After the trial there was a feature in 19 Direkte on DR* 1 Wednesday June 7th. It was announced that two 14-year-old girls, who had started collecting signatures demanding harsher sentences for rape, were invited in the studio.

The two girls were appalled with the mild sentences the boys from Bispehaven had received. T. sat ready by the TV to follow the feature. After talking to the girls the host encouraged the rapists to call in and discuss their feelings on their sentences. The sister of the 12-year-old boy who had participated in raping T. that night in Bispehaven followed up and called in. The host heard the 12-year-old in the background, and encouraged the boy to come to the phone. In the live broadcast the boy claimed that it was T. who had raped all of them…”

“It was completely disgraceful and very unethical. I didn’t think that DR would stoop to that kind of behaviour”. The mother adds.”

The parents feel that T. is all alone in defending herself. The media coverage have almost one sided focused on the statements of the boys their defence lawyers and friends, in their opinion. “T. has had a strong need to feel secure and protected. But she hunted game. The medias press on with their attacks of her. She doesn’t know when she’ll be put in the stocks again, or what she has to subject to the next time.” The father sighs.

“T. has so much anger in her, and her faith in the good in life has been replaced with a fundamental distrust in the world around her. So much has been destroyed in her.”

“I really feel that I’ve lost my daughter. She has the strangest look in her eyes, a mix of fear and anger. I cant’ help thinking about the book called “Man gjorde et barn fortræd”. The mother says and adds: “when she is with others her age, it is like she forgets. At those times she is her old self again in little flashes of time…”

“We doubt if she will ever be a whole and happy person again.”

“The trial has had consequences for others than T. her whole family have been scarred. The older sister has moved to another city. She had names like whore called after her, and in the busses she could read graffiti that was very unkind to her little sister.”

“There has also been an extra punishment for T. she is no longer able to walk around in Århus.” ”She’s afraid of what the boys friends might do, and now that they have been released she doesn’t feel safe. She is very uncomfortable with the whole situation,” the father comments. The other day the mother experienced in a bus that a group immigrant boys were sitting shouting: “R or not! R or not! Rape or not!”, very loud while laughing. “It was so unpleasant that it made me sick. That could have been some of them. I don’t know what they look like. To think if T had been with me.”

“On the 26th of may all of the boys found guilty of rape, but they received sentences that resulted in their release immediately afterwards.”

“The premise for the sentences was that the court stressed that the girl had only partially resisted.”

“”We’re proud of our daughter and we tell her that she did the right thing by not resisting. She didn’t dare, what if they had struck back. We are very happy to have our girl alive today.” The parents state.”
